If two separate entities currently own the .com.au and net.au domain names, then whoever held the name prior to 04.02.18 will be able to take up the .au domain name. If both held the names prior to 04.02.18, then it will be a matter of negotiation between the two parties.
If both created the names after 04.02.18 then it will be a matter of first in, best dressed.
